The way HMRC operates is changing with the passing into law of the Finance Act 2008, which gives inspectors far greater powers than previously. The Act gives them the right to enter your premises, check your records and access your computers, all with no right of appeal. In addition, the penalty regime has changed:
The penalties for failing to take “reasonable care” can be as much as 30% on an innocent error and a deliberate understatement carries a penalty of as much as 70%.
HMRC can open investigations into individuals or businesses at any time. These may be distressing and time-consuming regardless of the final outcome. We are able to represent clients with tax investigations and provide advice for dealing with HMRC.
